These General Terms and Conditions apply to the use of the online platform robothub24.ch (hereinafter “the platform”). The platform is operated by:
These GTC apply to all users (hereinafter “users”) of the platform, in particular to sellers and buyers of robots and robotics components. By registering on robothub24.ch, users declare their acceptance of these GTC.
The platform is currently offered in German; further languages (French, Italian, English) will follow. In the event of contradictions between the language versions, the German version of these GTC is authoritative.
The operator of robothub24 reserves the right to amend these GTC at any time. Users are informed of material changes by email at least 30 days before they take effect. Continued use of the platform after amended GTC take effect constitutes acceptance.
robothub24.ch is a Swiss online marketplace for buying and selling new and used robots as well as robotics components.
Under civil law, the purchase contract is concluded between buyer and seller. For VAT purposes, robothub24 is deemed to be the supplier towards the buyer in sales by private individuals; details are set out in section 2.2.
Where robothub24 enables a sale between a private seller and a buyer through the platform, robothub24 is deemed to be the supplier towards the buyer under art. 20a of the Swiss VAT Act. robothub24 states the VAT on the purchase price and accounts for it with the Federal Tax Administration.
This rule applies only to sellers resident or domiciled in Switzerland who are not entered in the VAT register. Sellers declare both facts at registration; robothub24 stores them with a timestamp and may verify a Swiss VAT number with the business identification register of the Federal Statistical Office.
Sellers entered in the VAT register, or domiciled outside Switzerland, may publish listings on the platform. However, no purchase is concluded through robothub24; buyer and seller deal directly with each other. For such listings robothub24 charges no sales fee.
robothub24 does not operate its own escrow account. The purchase price is settled directly between buyer and seller and does not pass through robothub24.
For transactions with a purchase price above CHF 200,000, robothub24 can refer the parties to a licensed escrow agent. That service is provided by a third party, is governed by its own terms and is subject to a fee. robothub24 is not liable for its performance.
Listing is free of charge. Where a sale is concluded through the platform, robothub24 invoices the seller a sales fee. It starts at eight per cent and slides down to four per cent as the price rises; above a purchase price of CHF 200,000 the fee no longer grows. The applicable rates and a calculator are available at robothub24.ch/gebuehren.
Statutory VAT is levied on and stated with the sales fee. Price changes are communicated to users by e-mail at least 30 days in advance.
robothub24 maintains a separate, continuously updated prohibited items list at robothub24.ch/verbotsliste. That list forms an integral part of these terms.
Commercial sellers require a subscription in order to publish listings. It costs CHF 49.00 per month or CHF 528.00 for one year paid in advance. It includes a dealer profile, the messaging system, statistics on your own listings and up to five simultaneously active listings at a price of no more than CHF 20,000 each.
Listings beyond that scope incur monthly surcharges based on price: CHF 49.00 from CHF 20,001 to 50,000, CHF 99.00 up to CHF 100,000 and CHF 199.00 above that. Each listing beyond the five included costs a further CHF 19.00 per month. These surcharges are payable monthly for as long as the listing is active and are invoiced monthly, including where the year has been paid in advance. What counts is the position on the billing date; a change to a listing price during a period only takes effect with the following invoice.
Billing takes place at the end of each period. Where a payment card is on file, the amount is charged to it; otherwise the invoice is payable within 10 days. The subscription renews automatically for a further period unless it has been cancelled beforehand.
Cancellation takes effect at the end of the period paid for. No refund is granted for the part-period, including where the year was paid in advance. If payment is not made, no new listings can be published; listings already online remain visible until their own expiry date. The claim remains due.
Statutory VAT is levied on and stated with all amounts. The applicable rates are available at robothub24.ch/subscribe.
robothub24 offers three advertising placements on the home page. Each placement is occupied exclusively for the duration of a booking; there is no rotation. A booking runs for 30 days from activation and costs CHF 1,500.00 plus VAT. No volume discount is granted.
The process has two stages. A request is submitted first; it is non-binding and free of charge. robothub24 reviews the content and the sender and decides freely whether the advertisement is published. There is no entitlement to publication. Payment only falls due after approval, and activation only follows receipt of payment.
The advertiser is responsible for the advertised content, for the accuracy of the information and for the rights to images and text. Where visual material is produced in whole or in part using artificial intelligence systems, this must be declared with the request; robothub24 labels such advertisements accordingly.
No refund is due after activation. If a request is declined, or an approval withdrawn before payment, no costs arise. robothub24 may remove a running advertisement if it subsequently emerges that it contravenes the law, these terms or the prohibited items list; in that case the amount attributable to the remaining term is refunded.
Use of the platform requires registration. Natural persons aged 18 or over as well as legal entities are entitled to register, provided no local legal prohibitions apply.
Users are obliged to provide complete and truthful information, to keep their password secret, not to transfer their account to third parties and to inform robothub24 immediately of security incidents.
robothub24 distinguishes between private and commercial sellers. Commercial sellers must identify themselves as such and comply with applicable consumer protection law.
If a consumer buys from a commercial seller, they are entitled to the statutory rights of withdrawal. The withdrawal period is 14 days from receipt of the goods. For private-to-private sales there is no statutory right of withdrawal.
In the event of violations, robothub24 reserves the following measures: written warning, temporary or permanent suspension, removal of listings without refund, as well as civil or criminal action.
Listings must fully state the manufacturer, model, year of construction, serial number, at least 3 photos, condition and all known defects.
Listings are active for 10 days from the publication date. The seller can extend a listing free of charge by 7 days at a time, up to ten times, giving a total duration of 80 days. On request robothub24 extends automatically for as long as that allowance lasts. The seller is notified 7 days and again one day before expiry. After expiry the listing is automatically deactivated and can be republished at any time. Permanently inactive listings (>180 days) are automatically deleted.
It is prohibited to settle deals initiated via the platform outside of it in order to circumvent fees. Violations may lead to immediate account suspension.
The purchase contract is concluded exclusively between buyer and seller. robothub24 is not a contracting party.
A purchase concluded via the platform is, under Swiss law, a legally binding contract within the meaning of Art. 1 et seq. and Art. 184 et seq. of the Code of Obligations (CO). With the acceptance of a fixed-price offer, the award in an auction or the confirmation of the purchase request, a binding contract arises that obliges both parties to perform.
After the sale is concluded, robothub24 provides both parties with the information needed for settlement, in particular the name, address and bank details of the counterparty. Buyer and seller settle payment and handover directly between themselves.
The sales fee is invoiced to the seller immediately after conclusion. If the seller has a payment card on file, the fee is charged to it. Otherwise it is payable within 10 days of the invoice date.
If payment is not made, robothub24 issues staged reminders. From the second reminder, existing listings may be paused; from the third, the account may be blocked for new listings. The claim remains due in every case.
In the event of disputes, both parties can report a dispute via the platform. robothub24 makes a decision within 10 working days. For EU consumers: ec.europa.eu/consumers/odr
Part of the content published on the platform, in particular images, product descriptions, fact sheets and editorial articles, is created or prepared with the help of artificial intelligence systems. Such content is editorially reviewed and approved before publication; editorial responsibility lies with HIT Management AG. Content created or edited with the help of AI is labelled where this is legally required or appropriate for transparency.
Despite careful review, content created with the help of AI may contain errors, inaccuracies or outdated information. robothub24 accepts no warranty for the correctness, completeness, reliability and timeliness of the information provided, including editorial articles, fact sheets, technical details and AI-generated content. All content serves general information purposes and does not constitute legal, technical, financial or investment advice.
robothub24 is not liable for the correctness of listings, the performance of purchase contracts or damages arising from the settlement of payment between buyer and seller. Liability is limited to the amount of the platform fee charged in the transaction in dispute.
Users may only upload content (in particular images, texts and descriptions) for which they hold the necessary rights or have obtained the corresponding permission. The uploading user is solely responsible for content uploaded by users. robothub24 accepts no liability for copyright or other infringements of protective rights arising from content uploaded by users. The user indemnifies robothub24 against justified claims of third parties arising from such an infringement. robothub24 does not systematically review content in advance, but removes or blocks it without delay as soon as it becomes aware of an infringement. Illegal content can be reported at any time via the reporting function on each listing.
These GTC are subject to Swiss law. The place of jurisdiction is Zug, Switzerland, to the extent legally permissible.
Should individual provisions be invalid, this does not affect the validity of the remaining provisions.
